What is the Vermont Special Warranty Deed?

A limited warranty deed can be used in Vermont to convey title to real property. This type of deed is commonly used to convey property acquired through foreclosure. Limited warranty deeds are also used when a seller is unwilling to give a full warranty deed and the buyer is not willing to accept a quitclaim deed. There are no statutory deed forms for this state; common law legal language should be used in creating a limited warranty deed. The grantor in a limited warranty deed covenants that he is in lawful possession of the premises being conveyed and has good right and title to convey the same. There is also a covenant from the grantor to warrant and defend the title against all lawful claims and demands of persons claiming by, through, or under the grantor.

A limited warranty deed in Vermont must be signed by the grantor and acknowledged by the grantor before a town clerk, notary public, master, county clerk, judge, or register of probate before it can be recorded. An acknowledgment before a notary public in Vermont will be valid without an official seal being affixed to the notary's signature (27 341a). Notarial acts can be performed in Vermont or in another state. If a deed is acknowledged out of state according to the laws of such state where the acknowledgment is taken, the deed will be valid for recordation in Vermont. Out-of-state acknowledgments can be taken before any of the officers listed in 27 379.

Land records in Vermont are handled at a local level, which means that limited warranty deeds and other conveyances of real property are recorded in the town or city where the property subject to the deed is located. Until a limited warranty deed is signed, acknowledged, and recorded, it will not be effective to hold such lands against any person but the grantor and his or her heirs ( 342).

Review: I like that the quit claim form was fill in the blank on my computer instead of online, made it so much easier than having to do everything at once, at the mercy of the internet connection. Will refer others here.

Review: Thank you! My husband and I went in the get notary stamps for a Special Warranty Deed and a Post Nuptial Agreement. The representative was very knowledgeable and thorough with the notary process. She made sure we read and understood all documents that we were signing and they required us to recite in sworn statements that everything there was true and understood! I will be using the notary service again at Bank of America! The representative was very respectful and had a nice smile the entire time to make our visit great!

Review: This package of documents from Deeds.com has been extremely helpful, particularly for one who has never needed this kind of service before and is unfamiliar with legal documents in general. It is well worth the price; I would recommend this company to anyone needing help with legal documents and information.

Review: Most people coming to this sight will not have the knowledge for deeds. Therefore, I wish there were more instructions on when the Grantor signs and when the Grantee signs and the process steps to making the transaction final. I would give it 4 out of 5 starts

Review: I'm 84 and not all that smart when it comes to what a Lawyer usually helps you with, but I took a chance to see if I could do this. Walla, I was able to do it. I was helping my son who had a stroke a few years ago and the transaction went well. Thank you.

Review: Website is easy to use. I ordered the form, filled it out and uploaded it for recording. My only critique is that you can't preview the form before ordering and paying for it. I ordered a Deed of Full Reconveyance form only to find out I needed the Substitution of Trustee and Deedn of Reconveyance form instead. So I wasted $22 on the wrong form.

Reply from Staff

Thank you for your feedback. Order and payment for the incorrect order has been canceled. Have a wonderful day.
