Using Enhanced Life Estate Deeds in Vermont
Owners of real property located in Vermont have access to a useful estate planning document: the Enhanced Life Estate Deed.
In most cases, traditional warranty or quitclaim deeds convey a present interest in property, meaning that as soon as the grantor (seller) signs the deed, the grantee (buyer) owns the land. One way to forestall the transfer is to use a life estate, which allows the owner to keep possession until death. The grantee becomes what's known as a remainderman, or someone who holds a remainder interest in the property during the owner's life. To protect that interest, the grantee must agree to changes in the property's use. Note that transfers initiated under traditional deeds and life estates are permanent.
Enhanced life estate deeds, also known as Ladybird or Granai deeds, convey a revocable future interest in real estate, with the transfer of the remaining title rights to take place when the grantor (owner) dies. These deeds reserve all present ownership rights for the owners, including the right to sell, lease, mortgage or convey the property, with no obligation for notice to or authorization from the grantees.
Vermont's Ladybird deeds transfer the property outside of the owner's will, without the need for probate. Even so, to avoid unnecessary complications, owners should make sure there are no conflicting bequests in their wills.
Enhanced life estate deeds offer a flexible, convenient tool for a comprehensive estate plan, but they may not be appropriate in all cases. Contact an attorney with specific questions or for complex situations.

Review: Deeds.com made this process of electronic document recording so easy! The communication was quick, friendly, helpful and efficient. I am out of state and have administrative items to handle for my father who has Alzheimer's. Deeds.com is a great service. I highly recommend them, and will use them again when the time comes.

Review: The form I needed was correct and paginated as required. It was accepted w/o penalties. I was not happy about the information which I found way too scant. One sample form does not cover enough possibilities, more would be helpful. The instruction page is a bit better but sometimes it is not clear enough - sometimes it is not clear what the numbered items in the form correspond to. There is no guidance about the process and it would take very little to provide it. Example about "description", say where to find. There is a bunch of "free forms" attached but no guide on which are needed and when. Example: at the counter I was given a paper "conveyance" form and asked to fill it - I did not know it was needed and what it did and so I had not d

Review: Thank you for offering this service. We were getting several different answers on how to solve our problem, and all of them involved getting an attorney. You saved us a ton of money and using your document made everything super easy...no attorney needed! Thank you!

Review: So far the service seems good, simple to use. One criticism, the password change feature should require the user to re-enter their old password, new password, and re-enter the new password to make sure there is no typos. Thanks.

Review: My mind is blown! For some reason, our veteran title companies wouldn't record our deed but luckily, the assessor's page recommended Deeds and other sites to e-record. It was so simple and so convenient!

Review: Worked well for me to create a deed for a house I inherited. It was very thorough and easy to use. I have no experience with the law so I just googled terms I didn't understand and was fine. I also called land records a lot and ended up not needing a lot of the material included, but it was still good to have it.
